Can an HOA enter your property without permission? In Arizona, the answer depends largely on what your CC&Rs say.
In this video, I explain how many declarations allow emergency entry, such as when water is leaking into another unit or there is a condition creating damage or risk to the community. Some CC&Rs also include “self-help” provisions, which may allow the HOA, after notice, to enter the property, correct certain conditions, and charge the cost back to the owner.
If the governing documents are silent, associations often seek court involvement before taking action. The specific facts, the level of emergency, and the language of your CC&Rs all matter.
